Pursuant to Decision No. 11 039 / QD-BCT December 3, 2014 of the Ministry of Industry and Trade, the commodity is food (noodles, rice noodles, vermicelli, noodles, …) when exports and imports are subject to inspection check food safety (not the quality control).
Pursuant to Article 41 of the Food Safety Law No. 55/2010 / QH12 stipulates: “The conditions to ensure the safety of food exports
1. Meet the conditions to ensure food safety in Vietnam.
2. In accordance with the regulations on food safety of importing countries under contracts or treaties, international agreements on mutual recognition of conformity assessment results with the countries and territories associated trousers.”
Pursuant to paragraph 1 of Article 9 of Circular No. 28/2013 / TT-BCT dated 06/11/2013 of the Minister of Industry and Trade provisions: “The dossier of registration for state inspection on food safety for food import gate comprises:
a) certificate of registration of imported food inspection under Appendix I attached to this Circular;
b) A certified copy of receipt slip regulation conformity announcement or a certificate of conformity regulations on food safety by the Ministry of Health or the competent authority is authorized to issue the Ministry of Health;
c) Certified copies of goods import contract (Contract), the list of goods attached (packing list);
d) A copy certified and certified by organizations and individuals to import Bill of Lading (Bill of Lading); Invoice (Invoice); declarations of imported goods. ”
Pursuant to Clause 1 of Article 10 of the Circular on provisions: “The inspection agency was testing facility designated by the Ministry of Industry and Trade in performing the state inspection on food safety for food products imported under the responsibility management of the Ministry of Industry and Trade (hereinafter referred to as the inspection agency). ”
Pursuant to Clause 2, Article 14 of the Circular on provisions: “Term done
a) Issuance of certified shipments reached import requirements:
– For food under stringent inspection methods: No more than five (05) working days from the date of registration to obtain test samples plus time trial prescribed by test methods;
– For food under normal test methods and test reduction: No more than three (03) working days from the date of registration to obtain test samples plus time trial prescribed by test methods;
b) Issue notice only check food for the food records of test methods only check the records fell: No more than two (02) working days from receipt of the registration dossier fully tested , Invalid;
c) Notice of inspection results under stringent inspection methods and shipment notice unsatisfactory imports votes attached test results for each batch of product delivery to imports and reported to the Ministry Industry and Trade is five (05) days after the test results.
Within fifteen (15) working days after receiving the notice of the inspection agency to inspect shipments imported unsatisfactory, MOIT will decide to handle the shipment as stipulated. ”
Where the company is export shall apply similar import. Company proposals refer to the above provisions and direct contact with the relevant authorities to be guiding.
